Yes, one party may terminate the collaborative process. If the parties have signed a Collaborative Law Agreement providing for mediation or arbitration of the issues, the next step typically is to proceed with mediation or arbitration. In the event that a party desires to terminate the collaborative process and not proceed with mediation or arbitration (and desires to initiate a court proceeding) then each party must then retain new counsel for any litigation of the issues. As a result, few persons elect to fully terminate or ?quit? the collaborative process to proceed with litigation.
